Colorado Chief Bankruptcy Judge Dies
Judge known for open mind

Tuesday, February 18, 2003 - Chief Bankruptcy Judge Donald E. Cordova, who earned a reputation for fair dealing in 13 years on the bench, died of a massive heart attack on Saturday. He was 63.
Cordova was visiting family in California, where he was expected to attend a bankruptcy workshop for judges later this week, said U.S. Bankruptcy Court Clerk Brad Bolton.
Little information was available Monday and funeral arrangements hadn't been announced.
Among lawyers who handle bankruptcy cases, Cordova had a reputation for being open-minded and for moving through procedures quickly.
"But forget the legal stuff; he was just a nice man," said Paul Rubner, a bankruptcy lawyer with Rubner Padjen and Laufer in Denver.
Cordova had little experience in bankruptcy law when he took the bench in 1990 but learned quickly, said Lee Kutner of Kutner Miller Kearns.
"He had a great temperament on the bench, he was very fair and did an excellent job," Kutner said.
Cordova was one of nine children whose father worked for the city of Trinidad. He attended Regis College in Denver before receiving a law degree from the University of Colorado.
He was admitted to the bar in 1964 and worked as a prosecutor with the U.S. attorney's office in Denver during the Vietnam War. He once said that he found prosecuting draft evaders - many of whom said they were following their convictions - difficult.
"Most of them were good young men you knew you were never going to see again," Cordova said in an article in the Colorado Journal.
He left the U.S. attorney's office in 1982 and went into private practice.
He served as president of the Denver Bar Association in 1987 and 1988 and replaced Alan H.W. Shiff on the U.S. Bankruptcy Court bench in Denver in 1990.
Cordova was one of five bankruptcy judges serving on the court. In 2001 he replaced Marsha Krieger as chief judge after President Bush appointed her to fill a vacancy in U.S. District Court in Denver.
Among decisions he made as a judge was his approval of the sale of Boulder-based digital book publisher netLibrary to a nonprofit library group for $10 million in 2001.
He recently voided a three-year labor contract between the Colorado Springs Symphony Orchestra and its musicians.
Cordova, who with his wife, Patty, had four daughters, expected to retire next year, Bolton said.

Mississippi Attorney Indicted
In Bankruptcy Fraud Case
Dunn Lampton, U.S. Attorney for the Southern District of Mississippi, and Edwin L. Worthington, special agent in charge of the Federal Bureau of Investigation in Mississippi, announced Jan. 23 that William S. Boyd III, of Gulfport, Miss., was indicted by a federal grand jury and charged with bankruptcy embezzlement, bankruptcy fraud, and money laundering in connection with his representation of clients in bankruptcy court.Boyd made his first appearance in the case Jan. 23 before U.S. Magistrate Judge John M. Roper in federal district court in Biloxi, Miss.
Based upon the results of a seven-month investigation by the FBI, the 17-count indictment alleges that, from December 1999 through December 2000, Boyd embezzled approximately $395,500 from the bankruptcy estates of certain clients.
The bankruptcy fraud and embezzlement charges against Boyd carry a maximum sentence of five years' imprisonment, a maximum fine of $250,000, and a period of supervised release of up to three years.
The money laundering charges carry a maximum sentence of 10 years' imprisonment, a maximum fine of $250,000, or twice the value of the criminally derived property, and a period of supervised release of up to three years.
U.S. Attorney Lampton and FBI Special Agent in Charge Worthington stressed that an indictment is an accusation only and all defendants are entitled to a presumption of innocence.
Assistant U.S. Attorney Gaines Cleveland is the prosecutor in charge of the case.
Lampton praised the efforts of the FBI and the Office of the U.S. Trustee for their diligent work in the investigation of this case.

The American Board of Certification announced that the organization's first class of certified attorneys has reached the hallmark of ten years of consecutive certification. The names and firms of the eighty-eight attorneys in this first class are attached.

In an unusual move, Linda Ekstrom Stanley, who has served as U.S. Trustee for the Northern and Central Districts of California for the last 8 years, has been terminated by the U.S. Attorney General's office. Replacing her on a temporary basis will be William T. Neary, U.S. Trustee for the Northern and Eastern Districts of Texas.Stanley, who was appointed in 1994 by the Clinton Administration, said she does not know why she was dismissed.
